1. Acceptance of Terms

By accessing or using CertifiedDot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CertifiedDot provides a software platform for managing DOT compliance, specifically Driver Qualification Files and document expiration tracking. The Service is designed to assist fleet owners in organizing and maintaining compliance documentation.

3. Not Legal Advice

CertifiedDot is a software tool and does not provide legal, regulatory, or compliance advice. The Service is designed to help you organize documents, but it is your responsibility to ensure compliance with all applicable DOT and FMCSA regulations. We recommend consulting with a qualified compliance professional or attorney for specific regulatory guidance.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Electronic Signatures

The Service includes electronic signature functionality. By using this feature, you acknowledge that electronic signatures are legally binding under the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA). You consent to conducting transactions electronically and to receiving documents in electronic form.

6. Payment Terms

Subscription fees are billed monthly at $10 per active driver. A one-time setup fee of $99 per driver is charged when a driver is added. You may cancel your subscription at any time. Refunds are not provided for partial months.

7. Data Retention

We retain your data for a minimum of 3 years to comply with FMCSA Driver Qualification File retention requirements. You may request data export at any time. Upon account termination, data will be retained for the legally required period before deletion.

8. Limitation of Liability

To the maximum extent permitted by law, CertifiedDot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified terms.
